Content usage rights — important
Content created by influencers for businesses as part of an Orbly collaboration may be used by the business however they like. This includes reposting, editing, running ads, and using it on any platform or in-store — without further permission, provided the use is within reason and does not tarnish or disparage the creator's name or reputation in any way. By accepting a partnership, creators agree to this license. Additionally, Orbly may use content created by creators on the Orbly website and social media platforms for promotional purposes.
1. Acceptance of Terms
By accessing or using Orbly, you agree to be bound by these Terms. If you do not agree, you may not access or use the platform. These terms apply to all users, including businesses and influencers (creators).
2. Content Ownership & Usage Rights
When a creator produces content for a business as part of a credit-for-content collaboration, the business is granted a perpetual, royalty-free, worldwide license to use, reproduce, edit, distribute, and display that content across any medium — including social media, websites, advertisements, email campaigns, and in-store materials — in any format the business chooses. Businesses may use the content however they like without further permission from the creator, provided that such use is within reason and does not tarnish, disparage, or harm the creator's name, reputation, or brand in any way or form. Creators retain ownership of the underlying work but agree to this license as a condition of the partnership. Additionally, creators grant Orbly a perpetual, royalty-free, worldwide license to use, reproduce, edit, distribute, and display their content on the Orbly website and across Orbly's social media platforms for promotional purposes, including showcasing collaborations, marketing the platform, and featuring creator work in Orbly's own materials.
3. Credit-for-Content Model
Orbly facilitates partnerships where businesses offer store credit to creators in exchange for social media content. Credit has no cash value unless stated by the business. Orbly is not a party to the agreement between a business and a creator and is not responsible for the fulfillment of credit or content obligations.
4. User Responsibilities
Users agree to provide accurate information, respect intellectual property rights, not post unlawful or infringing content, and honor the terms of each partnership they enter. Businesses must fulfill offered credit, and creators must deliver agreed-upon content within the stated timeline.
5. Privacy
We respect your privacy. Personal data is collected and used in accordance with our Privacy Policy. We do not sell your personal information to third parties.
6. Limitation of Liability
Orbly provides the platform on an 'as is' basis. We are not liable for any disputes, damages, or losses arising from interactions between businesses and creators, including unfulfilled partnerships, content disputes, or expired credit. Users are solely responsible for their collaborations.
7. Changes to These Terms
Orbly may update these Terms at any time. Continued use of the platform after changes constitutes acceptance of the revised Terms. We will notify users of significant changes via email or in-app notice.
